Welcome to 904biz.com ("904biz," "we," "us"), a local business directory for St. Johns County, Florida, operated by Attract904, Michael Barrick, St. Augustine, Florida. By using the site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use 904biz.

These Terms have three parts: General Terms (everyone), Visitor Terms (people browsing, posting, or requesting matches), and Business Customer Terms (businesses that claim a listing or buy a plan).

Part A: General Terms

1. What 904biz is

904biz is a directory. We list local businesses, show publicly available information about them (including Google ratings and review snippets, with attribution), host user reviews and posts, and connect visitors with businesses. We are not a party to any transaction between a visitor and a business. We do not perform, guarantee, insure, or supervise any business's work.

2. No endorsement; accuracy disclaimer

Listings, ratings, reviews, and descriptions are provided for information only. A listing, badge, "Premium," "Featured," or "Category Sponsor" label means the business paid for placement or claimed its listing; it is not an endorsement, recommendation, license check, or guarantee of quality. Information may be incomplete, outdated, or wrong. Verify licenses, insurance, and pricing directly with the business before hiring anyone.

3. Eligibility and accounts

You must be at least 18 to create an account or submit a Get matched request. We sign you in with an email magic link; keep your email account secure and do not share sign-in links. You are responsible for activity under your account.

4. Your content and our license

"Content" means reviews, Q&A, deals, events, photos, replies, business descriptions, and anything else you post. You keep ownership of your Content. By posting, you grant 904biz a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, reproduce, adapt (for formatting and excerpts), and distribute that Content on the site, in search results, in email digests, and in promotion of 904biz, for as long as it is on the site and for a reasonable time after removal in backups and caches. You confirm you have the right to post it and that it is truthful and your own experience.

5. Content rules and moderation

Do not post content that is false, defamatory, harassing, discriminatory, obscene, infringing, spam, or that reveals someone's private information. Do not review your own business, a competitor, an employer, or a family member's business, and do not pay or trade for reviews. We may review, edit for format, decline, or remove any Content at any time, with or without notice, and may suspend or close accounts for any reason. We are not required to publish anything. Reviews express the opinions of their authors, not 904biz.

6. Third-party content and links

Google ratings and review snippets belong to Google and their authors and are displayed under Google's terms. Links to business websites and other third parties are provided for convenience; we are not responsible for them.

7. Intellectual property and DMCA

904biz, its design, logo, and compiled directory are owned by Attract904. If you believe content on 904biz infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent: DMCA Agent, Attract904, [Street address], St. Augustine, FL [ZIP], dmca@904biz.com. Include your contact information, a description of the work, the URL of the material, a statement of good-faith belief, a statement under penalty of perjury that your notice is accurate, and your signature. We will remove or disable access to infringing material and may terminate repeat infringers. Counter-notices may be sent to the same address.

8. Acceptable use

You may not scrape, bulk-download, or copy the directory; reverse engineer the site; use bots; circumvent security; impersonate anyone; or use 904biz to send unsolicited messages. You may not use contact information found on 904biz for telemarketing or spam.

9. Disclaimers

904biz is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by Florida law, 904biz, Attract904, and Michael Barrick are not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost leads, lost data, or harm arising from any business, service, or person you find through 904biz. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) $100. Some states do not allow these limits; they apply only as far as the law allows.

11. Indemnity

You agree to defend and hold harmless 904biz and Attract904 from claims arising from your Content, your business, your use of the site, or your violation of these Terms or any law.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, you agree to email us and give us 30 days to try to resolve it informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in St. Johns County, Florida, and you consent to their jurisdiction. Either party may bring an individual claim in small-claims court. You and 904biz each waive any right to a jury trial and to participate in a class action. [Attorney note: consider binding arbitration with a 30-day opt-out as an alternative.]

13. Termination

You may stop using 904biz at any time. We may suspend or terminate access for violations or for any reason. Sections 2, 4, 9 through 12, and the payment terms in Part C survive termination.

14. Changes

We may update these Terms. Continued use after the "Last updated" date means you accept the changes. Material changes affecting paid plans will be emailed to account holders.

Part B: Visitor Terms

15. Get matched requests

When you submit a Get matched form, you authorize 904biz to share your name, phone, email, and request details with up to three businesses we select as relevant. You agree those businesses may contact you by phone, text, or email about your request. We do not guarantee any business will respond, be available, or be suitable. Any agreement you make is between you and the business alone.

16. Reviews, Q&A, deals, and events

Your posts must be based on your genuine first-hand experience. You must disclose any connection to the business. Deals and events are posted by businesses; terms, availability, and accuracy are the business's responsibility. Report problems to us and we will review them.

17. Your account

Magic links expire and are for your use only. Tell us right away if you believe someone else accessed your account.

Part C: Business Customer Terms

These terms apply in addition to Parts A and B when you claim a listing or purchase a plan.

18. Seeded listings and claiming

Many listings are created from publicly available business information gathered from Google Maps through a licensed data provider. Claiming a listing requires verification that you own or are authorized to represent the business. By claiming, you confirm that authority and agree to keep your listing accurate. If you prefer not to be listed, use the "Remove my business" link or email remove@904biz.com; we will remove the listing within 10 business days after verification. Removal does not affect information on Google or other sources.

19. Your listing content and AI-drafted descriptions

You are responsible for everything in your listing: hours, pricing, photos, deals, events, replies, and credentials. We may offer AI-drafted descriptions as a starting point; nothing goes live until you review and approve it, and once approved it is your Content. Do not claim licenses, certifications, or insurance you do not hold. We may correct obvious errors or remove content that violates these Terms.

20. Plans, billing, and auto-renewal

• Plans. Premium ($297/year), Featured ($699/year), monthly options, and Category Sponsor placements, as described on the pricing page at the time of purchase.
• Payment. Processed by Stripe. You authorize us to charge your payment method on the billing schedule you select.
• Auto-renewal. Plans renew automatically at the end of each term at the then-current price unless you cancel before the renewal date. We will email a reminder before annual renewals.
• Cancel anytime. Cancel from your account or by emailing billing@904biz.com. Your plan stays active until the end of the paid period.
• No partial refunds. Fees are non-refundable for partial months or years, except where required by law or at our discretion for a billing error.
• Failed payments. If a charge fails, we may downgrade or suspend paid features after notice.
• Price changes. We may change prices with at least 30 days' email notice before your next renewal.

21. Placement and leads: no guarantees

Premium, Featured, and Category Sponsor plans buy visibility (position, badges, extra content, lead routing), not results. We do not guarantee any number of views, clicks, calls, leads, or customers. Category Sponsor placements are limited in number per category, are sold first-come, and may be rotated or redesigned as the site evolves. Leads delivered to you may be shared with up to two other businesses. You must use lead information only to respond to that request and in compliance with law; you may not add leads to marketing lists without their separate consent.

22. Communications consent (TCPA and Florida Telephone Solicitation Act)

During sign-up you may check boxes agreeing that 904biz, Attract904, and their service providers may contact you at the phone number you provide by (a) SMS/text messages, (b) live voice calls, and (c) automated, prerecorded, or AI-assisted calls and messages, including calls placed using an automated system for the selection or dialing of telephone numbers, about your listing, account, billing, leads, and 904biz products and services. You understand that consent is not a condition of purchasing any good or service, that message and data rates may apply, that message frequency varies, and that you may revoke consent at any time by replying STOP to a text, saying so on a call, or emailing us. Checking the box is your electronic signature and your prior express written consent under the Telephone Consumer Protection Act, 47 U.S.C. § 227, and the Florida Telephone Solicitation Act, Fla. Stat. § 501.059. We will honor stop requests within 15 days as Florida law requires and will not contact you before 8 a.m. or after 8 p.m. in your time zone. You confirm you are the regular user of the number provided and will tell us if it changes.

23. Email

By creating a business account you agree to receive transactional emails. Marketing emails will include an unsubscribe link, and you can opt out at any time without affecting your plan.

24. Business representations

You represent that your business is lawfully operating, holds any licenses required for the services you advertise, and that your listing, deals, and events comply with Florida and federal advertising law, including the FTC's rules on endorsements. You will not use 904biz to solicit, harass, or send unsolicited messages to visitors or other businesses.

25. Suspension and removal of paid listings

We may suspend or remove a paid listing that violates these Terms, receives credible complaints of fraud or unlicensed activity, or poses legal risk. If we terminate your plan for a violation, no refund is owed. If we discontinue a plan for our own reasons, we will refund the unused portion on a pro-rata basis.

26. Taxes

Prices exclude any applicable sales tax, which will be added where required.
