  In 2019, I Mike Chiellino, after my wife and I were involved in a catastrophic car accident, I contacted John Fagan’s office about possible representation while my wife was still hospitalized. Someone from his office came to my home to discuss the case. Because of the seriousness of what we were dealing with, I asked my lawn service provider to sit in and listen to the conversation as a witness. During that meeting, I recall being told that we should claim the loss of a laptop. I would not make a claim for property that was not damaged. I was not looking for someone to manufacture damages or increase the value of a claim through something that was not true. I wanted honest representation, and for that reason I decided not to continue with the firm. Years later, while reviewing insurance-company records in connection with ongoing litigation, I discovered an email John Fagan sent directly to the insurance carrier’s attorney after being asked whether his office still represented us. Mr. Fagan wrote: “I did get an email from them saying they don’t want us to continue representation.” He then told the insurance attorney: “When they got the letter indicating the global mediation, I think they figured they could ditch us and do it themselves.” That was not why I chose not to continue with the firm. Mr. Fagan also wrote: “The big problem is they have huge medical liens from hospitals.” He further stated: “Mellissa’s medical bills will likely exceed all coverages.” And then: “Sometimes they will return to us when they find out they will have to deal with the medical out of the settlement. Maybe after they hear this from a third party they will call us back.” For the record, nobody came running back. I personally dealt with more than 10 attorney offices and other entities regarding medical liens that totaled well over $1 million. I resolved those liens myself, promptly, and ultimately paid less than $2,000 total. So the assumption that we would discover we could not handle the liens and return to his office was simply wrong. Reading this correspondence years later was extremely disappointing. Instead of simply telling the insurance attorney that we had chosen not to continue the representation, Mr. Fagan speculated about our motives and suggested we would likely return once we realized how difficult the lien issues were. I knew why I declined the representation then, and I know why now. For me, honesty from an attorney is non-negotiable. If I have concerns about honesty at the very beginning of a professional relationship, I am not going to trust that relationship with something as important as a catastrophic-injury case. Based on my personal experience and the correspondence I have now seen, I would not use this firm.
